In short, we view the following terms not as random small print, but promises to our customers and their pets. We care about the well-being of pets, and so we put a great deal of effort into designing our products and we cover them by limited warranty. In addition, our focus is on making great products, and we choose to let the products market themselves. We care about our customer’s privacy, to secure any data provided and do not freely share it. In addition, we do not use customer information to send marketing information, apart from the information our customers explicitly subscribe to receive.

Limited Product Warranty

LUMO LLC (LUMO) provides a limited warranty to the original purchaser that our products are free from defects in material and workmanship for a period of one (1) year.

This limited warranty is offered solely to the original retail purchaser, and is not transferable to subsequent purchasers. LUMO's sole obligation under this limited warranty is to, at its discretion, either; (a) exchange the defective product for a fully-functional identical model, (b) credit the original purchase price towards other LUMO products, or (c) provide a full refund. LUMO must be notified in writing, to info@lumo.com, of any claim under this limited warranty within 60 days of discovering any defect.

Any product that may have been replaced under this limited warranty, will have coverage for the longer of; (a) ninety (90) days from the date of replacement; or (b) the remaining original limited warranty period.

To the extent that any defect or failure is reasonably attributable to abuse, misuse, alteration, modification, accident, neglect, or other abnormal, excessive or improper conditions or use, this limited warranty will be void.

The limited warranty set forth above is provided in lieu of all other warranties and LUMO hereby disclaims all other warranties of any kind, whether express, implied, statutory or otherwise, including without limitation any warranties of merchantability, fitness for a particular use or purpose, quality and title. LUMO does not warrant that the product is error free or that it will function without interruption. To the extent that LUMO may not, as a matter of applicable law, disclaim certain implied warranties, the duration of any such implied warranty shall be limited to the shorter of the one (1) year limited warranty period or the minimum time period permitted under such law. Some states do not allow limitations on the duration of implied warranties, so the above limitation may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

Privacy Policy

This policy describes what information we collect and how it's used and shared. If you don’t agree with the terms of this Privacy Policy, you may not access or use www.lumo.com. If you have any comments or questions about this Privacy Policy, please CONTACT US.

1. Core Principles
   When it comes to your personal information we believe in transparency, not surprises. So before we get into the details, we want to share with you a few of our core privacy principles. First, we don’t sell your personal information to anyone. It’s just not the type of business we’re in. Second, we don’t ask for your personal information unless we need it to provide or improve the services and products we provide to you. Third, we don’t share your personal information unless you’ve specifically allowed it, or for the very limited purposes described below. Finally, we appreciate that when you use www.lumo.com, you trust us with your information, and we take that responsibility very seriously. This Privacy Policy holds us accountable for protecting your rights and your privacy.
2. Data Collection
   When you use the www.lumo.com, we collect the following information, and use it only as described below:
   2.1 Contact Information. This may include your name, address, email address and phone number, which is used only to communicate with you for as long as we need it to provide you with our service or process a product order. We may additionally use that information to send marketing or promotional communications, if you chose to receive them. Refer to 8.
   2.2. Payment Information. When you provide your payment information to place an online order at www.lumo.com, we transmit it via an encrypted connection to our Payment Processor, Stripe. Stripe uses and processes your payment information in accordance with Stripe’s Privacy Policy. We don’t store your payment information, other than your zip code and country, which we require for billing and to comply with tax and other government regulations.
   2.3. Communications with Us. When you send us emails or other communications, such as customer support inquiries, we maintain those communications and their contents so that we can resolve your inquiries or otherwise assist you. In addition, we may also anonymize that information to use it for training purposes, learn from the issues that occasionally arise and to help us improve the service we provide to customers.
   2.4. Usage Information. This includes information about your activity on and interaction with www.lumo.com, such as your IP address, your device or browser type, the web page you visited before coming to our sites and identifiers associated with your devices. This information enables us to analyze how www.lumo.com is being accessed and used, and to track our web performance and effectiveness of marketing outreach.
   2.5. Location Information. Your devices (depending on your settings) may transmit location information to www.lumo.com. We may use this information to customize, improve and protect www.lumo.com. For example, we may use your location information to determine local language preferences, or currencies.
   2.6. Cookies and Other Technologies. We use these technologies to do things such as remember your preferences, keep you safe and improve and promote www.lumo.com.
3. Sharing
   When you use www.lumo.com, we may only share your information only as described below:
   3.1. Following the Law. We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to comply with the law, protect our rights or prevent fraud or abuse of www.lumo.com or our customers. When we receive law enforcement or national security requests for information, we strongly believe in privacy and transparency. We scrutinize such requests carefully and challenge vague, overbroad or otherwise unlawful requests. And when legally permitted, we provide our customers with notice that their information is being requested. This notice is provided so that you have the opportunity to challenge such requests.
   3.2. Others Working For LUMO. LUMO uses certain trusted third parties to help us provide, improve, promote and protect www.lumo.com. For example, we may use third parties to help us provide customer support, manage our ads on other sites or assist with data storage. These third parties may access, process or store your information to perform tasks only for the purposes we’ve authorized, and we require them to provide at least the same level of protection for your information as described in this Privacy Policy. We also may share with third parties aggregated or anonymized information that does not directly identify you.
   3.3. Business Transfers. If we're involved in a reorganization, merger, acquisition or sale of our assets, your information may be transferred as part of that deal.
4. Protection
   While no website is completely secure, we employ security measures such as using firewalls to protect against intruders and protect data, building redundancies throughout our network (so that if one server goes down, another can cover for www.lumo.com) and testing for and protecting against network vulnerabilities. Payment information is transmitted using HTTPS encryption.
5. Retention
   We'll retain your personal information for as long as we need it to provide you with our services. You can ask for your personal information to be deleted at any time by contacting us at info@lumo.com. Please note that there may be latency in deleting your personal information from our servers and backup storage, and we may retain your personal information in order to comply with the law, protect our rights, resolve disputes or enforce our agreements.
6. Location
   Information that you submit through www.lumo.com may on occasion, be transferred to countries other than where you live (for example, to customer support centers outside the US). We require everyone who helps us to serve our customers, provide at least the same level of protection for your information as described in this Privacy Policy.
7. Access
   We may retain certain information as required by law or for necessary business purposes. On request to info@lumo.com, we'll provide you with a copy of your personal information that we maintain. This request may be subject to a fee not exceeding the prescribed fee permitted by law.
8. Communications
   We may periodically email you service-related announcements. We'll also send you emails related to your transactions. We may also send you marketing or promotional communications, but you can opt out of receiving subsequent marketing or promotional communications by clicking the link marked unsubscribe (or a similar phrasing) that’s included in those communications.
9. Privacy Shield
   9.1. Compliance. www.lumo.com complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union to the United States (“EU Personal Data”).
   9.2. Accountability. Our accountability for EU Personal Data we receive under the Privacy Shield and subsequently transfer to a third party is described in the Privacy Shield Principles. In particular, we may use third parties to process data on our behalf as described in this Privacy Policy, and we remain liable if they do so in a manner inconsistent with the Privacy Shield Principles and we're responsible for the event giving rise to the damage.
   9.3. Inquiries and Disputes. If you have questions you believe to be within the scope of our Privacy Shield certification, please contact us first at info@lumo.com and we'll respond within 45 days. For any complaints that we can’t resolve directly, JAMS is the independent organization responsible for reviewing and resolving complaints about our Privacy Shield compliance, and you can contact JAMS at https://www.jamsadr.com/eu-us-privacy-shield. In the event your concern still isn't addressed by JAMS, you may be entitled to a binding arbitration under the Privacy Shield Principles. For purposes of enforcing compliance with the Privacy Shield, www.lumo.com is subject to the investigatory and enforcement authority of the U.S. Federal Trade Commission.
10. Modifications
    We may modify this Privacy Policy from time to time, and will post the most current version on our website.

Conditions of Use

The following conditions govern your use of www.lumo.com, provided by LUMO LLC.

Your access to and use of www.lumo.com requires your acceptance of and compliance with these Conditions of Use. These terms apply to all visitors, users and others who wish to access or use www.lumo.com.

1. Online Product Purchases

   1.3 We reserve the right to refuse or cancel your order at any time for reasons including, but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons at our discretion.
   1.4 We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
   1.5 We reserve the right to change the prices of our products on www.lumo.com at any time.
2. Product Availability, Errors and Inaccuracies
   2.1 We are constantly updating product and service offerings on www.lumo.com. We may experience delays in updating information on our website and in our advertising on other web sites. The information found on www.lumo.com may contain errors or inaccuracies and may not be complete or current. Products or services may be mispriced, described inaccurately, or unavailable on www.lumo.com, and we cannot guarantee the accuracy or completeness of any information found on this web site.
   2.2 We reserve the right to change or update information on www.lumo.com, and to correct errors, inaccuracies, or omissions at any time without prior notice.
3. Intellectual Property and Copyright
   3.1 Our website www.lumo.com and its original content, features and functionality are and will remain the exclusive property of LUMO LLC and its content licensors where applicable. Our website www.lumo.com is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and logos may not be used in connection with any product or service.
   3.2 We welcome customer feedback, ideas or suggestions, but in providing this to LUMO LLC you agree that we may use your feedback, ideas or suggestions, without any restriction or obligation to you.
   3.3 We respect the intellectual property of others and ask that you do too. We respond to notices of alleged copyright infringement if they comply with the law, and such notices should be reported via info@lumo.com.
4. Customer Content
   4.1. Customers visiting www.lumo.com, and the associated social media pages of LUMO LLC, may provide us with content, including without limitation text, photos, images, audio, video, code and any other materials to share online. Your content stays yours. These terms don't give us any rights to content customers provide, except for the limited rights that enable us to provide, improve, promote LUMO as described herein.
   4.2. When you provide content via www.lumo.com, or any associated social media pages of LUMO LLC, you grant LUMO a non-exclusive, worldwide, perpetual, royalty-free, sublicensable, transferable right and license to use, host, store, reproduce, modify, create derivative works of, communicate, publish, publicly display, publicly perform and distribute user content for the limited purposes of allowing us to promote LUMO, our customers use of our products, our relationship with our customers, and their relationships with their pets.
5. Links to Other Websites
   Our website www.lumo.com may contain links to third party web sites or services that are not owned or controlled by LUMO LLC.
   5.1 LUMO LLC has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
   5.2 You acknowledge and agree that LUMO LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.
   5.3 We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.
6. Termination
   6.1 We may terminate or suspend your access to www.lumo.com immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these terms.
   6.2 All provisions of the Conditions of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
7. Indemnification
   You agree to defend, indemnify and hold harmless LUMO LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of www.lumo.com, or b) a breach of these terms.
8. Limitation of Liability
   In no event shall LUMO LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use of www.lumo.com; (ii) any conduct or content of any third party on www.lumo.com; (iii) any content obtained from www.lumo.com; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. Disclaimer

   9.2 LUMO LLC, its subsidiaries, affiliates, and its licensors do not warrant that a) www.lumo.com will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) www.lumo.com is free of viruses or other harmful components; or d) the results of using www.lumo.com will meet your requirements.
10. Exclusions
    Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
11. Governing Law
    11.1 These terms shall be governed and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions.
    11.2 Our failure to enforce any right or provision of these Conditions of Use will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement between us regarding our service on www.lumo.com, and supersede and replace any prior agreements we might have had between us regarding this service.
